지난해 8월부터 탐정업이 합법화됐지만 여전히 탐정을 관리할 수 있는 가칭 탐정업법은 제정되지 않았다. 탐정업체와 관련 단체가 급증하고 있지만 관리 주체가 없는 아노미(anomie) 상태가 지속되고 있다.미국, 영국, 일본 등 선진국의 탐정이 수행하는 업무가 100여가지 이상이지만 국내에서는 아직까지 명확한 기준이 없다. 혼란한 상황에 대한 이해를 돕고자 미국 탐정의 조사 사례를 연구해 시리즈로 소개할 예정이다.미국 탐정기업 MCI(McClain Investigations, Ltd.)는 불쾌한 자녀 양육권 사건에 연류된 고객 A로부터 전 부인 B에 대한 조사를 의뢰받았다. 사건의 쟁점은 B가 자녀를 돌보는 동안에도 지속적으로 컴퓨터를 사용했다는 것이었다. 고객 A는 자녀 양육권 소송에서 유리한 증거를 확보하기 위해 탐정사무소를 방문했다.MCI의 포렌식 조사관은 A로부터 B가 사용했던 컴퓨터를 입수해 포렌식 조사를 진행했다. 컴퓨터 포렌식을 통해 B가 인터넷을 통해 발송한 다수의 노골적인 사진과 이메일을 확보했다.또한 B가 인터넷 채팅 기록에서 아기 양육으로 인해 속상하다는 글을 발견했다. 아이의 존재 자체를 불평하는 내용이 대부분이었다.이렇게 수집된 증거들은 A에게 보고서 형태로 전달됐다. 미국  엑스퍼티스(Expertise)가 뉴욕시 Top 18에 링크된 탐정기업 WIN(Worldwide Intelligence Network, 이하 WIN)는 고객으로부터 딸의 스토킹 조사를 의뢰받았다.의뢰자의 딸인 젊은 여성은 익명으로 부터 매우 생생하고 폭력적이고 충격적인 문자 메시지와 이메일을 받았다. 그녀와 함께 살고 있던 다른 여성 역시 문자메시지와 이메일에 두려움과 극도의 위협을 느꼈다.그녀는 축구팀에서 나와 연습장에 되돌아가지 못하고 있었다. 축구 경기를 중단한 이유는 팀원 중 한명이 메시지를 보내고 있다고 생각했기 때문이다.WIN의 조사관들은 명백한 단서를 바탕으로 조사를 시작했다. 스토킹 사건을 조사하던 중 그녀가 삭제를 하지 않아도 휴대폰에서 문자메시지와 이메일이 삭제된다는 사실을 발견했다.따라서 피해자의 전화에 지속적으로 접근할 수 있는 가장 가까운 사람이라고 판단해 같이 생활하고 있는 룸메이트에 대한 인터뷰를 진행했다. 인터뷰 및 조사 과정에서 함께 살고 있는 룸메이트에 대한 법원 기록을 조사했다. 법원의 접근 금지 명령과 룸메이트가 이전에 함께 동거했던 다른 여성을 포함한 특징적인 사실을 발견했다.법원의 기록 및 배경 조사를 실시해 법원에 접근 금지 명령을 신청한 사람을 찾아냈다. 그녀와의 인터뷰에서 당시 가해자의 특징이 현재의 룸메이트와 매우 유사하다는 사실을 발견했다.탐정이 그동한 조사한 증거들을 의뢰자에게 제출했다. 의뢰자의 딸은 모든 소지품을 챙기고 숙소를 떠나 룸메이트와의 관계를 청산했다.탐정기업 WIN은 29년 이상 경력을 바탕으로 전 세계 16개 국가에 각종 조사와 요인 경호와 관련된 업무를 처리한다.주요 업무는 배우자나 파트너 부정 조사, 감시 조사, 경영진 배경 조사, 종업원의 부정직한 행위나 산재보상 사기 소송 등을 다룬다. ▲ Worldwide Intelligence Network 홈페이지 Case Study: Lindsay Protects Herself From a StalkerHow Lindsay protects herself from a stalker. We received a call from Janet (not her real name) about her daughter, Lindsay (not her real name).Lindsay was a young adult who had been receiving very graphic, violent and disturbing text messages and emails from an anonymous person.Lindsay lived with her significant other (a female). They were both terrified by the verbiage in the texts and emails.Feeling extremely threatened and in fear for their lives, they both eventually resigned from their soccer team and never returned to the practice field.The reason they discontinued playing on the team was because they believed that the messages were being sent from one of their teammates.It was unfortunate, because soccer was the one thing they enjoyed doing.Our take on this private investigation was that the clues were simply too obvious and we thought we should look elsewhere other than at the teammates.Commencing our stalking investigation, we learned that the text messages and emails on Lindsay’s cell phone would suspiciously disappear, even though she did not delete them.This was a clue that it had to be someone very close to Lindsay, since they would have access to her phone to delete the messages.The one person who would have constant access to the victim’s phone was her significant other.With her permission, we interviewed Lindsay’s significant other.
